1. Acceptance of Terms

By accessing or using TrybeCRM (“the Service”), operated by Clear Story Labs LLC (“we,” “us,” or “our”), you agree to be bound by these Terms & Conditions. If you do not agree, do not use the Service.

2. Description of Service

TrybeCRM provides customer relationship management tools, automated messaging, and follow-up campaign services designed for small businesses. The Service is built on third-party infrastructure and may include features powered by third-party providers.

3. Account Registration

To use the Service, you must create an account and provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

4. Free Trial & Payment

We may offer a free trial period. After the trial ends, continued use of the Service requires a paid subscription. All fees are non-refundable unless otherwise stated. We reserve the right to change pricing with 30 days' notice.

5. Acceptable Use

You agree not to:

• Use the Service for unlawful purposes or to send unsolicited messages (spam)
• Violate any applicable laws, including the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, or similar regulations
• Interfere with or disrupt the Service or its infrastructure
• Attempt to gain unauthorized access to any part of the Service
• Resell or redistribute the Service without written permission

6. Messaging Compliance

You are solely responsible for obtaining proper consent from your customers before sending any automated messages through the Service. You must comply with all applicable messaging laws and regulations, including but not limited to TCPA, CTIA guidelines, and carrier requirements. We are not liable for any claims arising from your messaging practices.

7. Intellectual Property

The Service, including its design, features, and content, is owned by Clear Story Labs LLC and protected by applicable intellectual property laws. You retain ownership of the data you upload to the Service.

8. Data & Privacy

Your use of the Service is also governed by our Privacy Policy. By using the Service, you consent to the collection and use of information as described in that policy.

9. Limitation of Liability

To the fullest extent permitted by law, Clear Story Labs LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Service is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Termination

We may suspend or terminate your access to the Service at any time for any reason, including violation of these Terms. You may cancel your account at any time. Upon termination, your right to use the Service ceases immediately.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page with a new “Last updated” date. Continued use of the Service after changes constitutes acceptance of the revised Terms.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts located in Delaware.
